Supreme Court upholds the Partial Birth Abortion Ban!
Today the Supreme Court upheld the nationwide ban on the partial-birth abortion. According to Mark Sherman of the Associated Press, it was a 5-4 ruling that the Partial Birth Abortion Ban Act that President Bush signed into law in 2003 does not violate a woman’s “constitutional right” to have an abortion.
Conservative bloggers have already gone wild in spreading the good news. Still, there is much work ahead in making all abortions a thing of the past- but this is an important, indeed a landmark, first step down the road leading back towards respecting the sanctity of life.
Bush’s two appointments did not disappoint as both Chief Justice John Roberts and Justice Samuel Alito were in the majority. The three other justices that supported the ruling were Anthony Kennedy, Clarence Thomas, and Antonin Scalia.
Praise be to God for this answer to so many prayers.

This was the right decision, made for the right reason. The procedure in question seems indistinguishable from infanticide and is indeed, as President Bush put it, an “abhorrent procedure.” Concern for the health of the mother was addressed by Justice Kennedy when he pointed out that “the court could entertain a challenge in which a doctor found it necessary to perform the banned procedure on a patient suffering certain medical complications.” No one’s rights are jeopardized by our taking the moral high ground on this particular point of the abortion controversy.

Elections do matter! This ruling is a perfect example of what would have happened if John Kerry had won the last election. Chief Justice Roberts and Justice Alito would not have been appointed to the Supreme Court. Instead we would have two more liberals who would have allowed this brutal procedure to continue for another 40 years. I am thankful that President Bush had the opportunity to name these two fine men to the highest court in the land. I only wish he could have chosen one more.
